1. Acceptance of Terms

By accessing or using Aimerce.io ("Aimerce", "the platform", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the platform. These terms apply to all users, including free and paid subscribers.

2. Description of Service

Aimerce is a SaaS platform that automates e-commerce product launches. It imports product data from dropship supplier URLs, rewrites content using AI, creates Shopify product listings, generates AI-powered ad creatives (images and videos), and publishes advertising campaigns to Meta (Facebook/Instagram) — all on behalf of the user.

3. Account Registration

• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your account credentials.
• You may not share your account with others or create multiple accounts to circumvent usage limits.
• You must be at least 18 years old to use Aimerce.

4. Acceptable Use

You agree to use Aimerce only for lawful purposes. You may not:

• Use the platform to create ads or listings for illegal, counterfeit, or prohibited products.
• Violate the terms of service of Shopify, Meta, or any other connected platform.
• Scrape, reverse-engineer, or attempt to extract proprietary technology from Aimerce.
• Use Aimerce to infringe the intellectual property rights of others.
• Attempt to gain unauthorized access to any part of the platform or its infrastructure.
• Use automated scripts to interact with Aimerce outside of its intended API.

5. Third-Party Integrations

Aimerce connects to third-party services including Shopify and Meta (Facebook). You are responsible for ensuring your use of these integrations complies with their respective terms of service. Aimerce acts as an authorized agent on your behalf and is not responsible for actions taken by those platforms (e.g., ad account suspension, policy enforcement).

By connecting your Meta account, you authorize Aimerce to create and manage ad campaigns on your behalf using the permissions you grant during the OAuth flow.

6. AI-Generated Content

Aimerce uses AI to generate product descriptions, ad copy, images, and videos. You acknowledge that:

• AI-generated content may not always be accurate, complete, or suitable for your specific use case.
• You are responsible for reviewing all AI-generated content before publishing.
• Aimerce does not guarantee that generated content will comply with advertising platform policies.
• You own the rights to content generated through your account using your inputs.

7. Payment & Subscription

Certain features of Aimerce require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All payments are non-refundable unless otherwise stated or required by applicable law. We reserve the right to change pricing with 30 days' notice.

Failure to pay may result in suspension or termination of your account.

8. Intellectual Property

All software, design, and technology underlying the Aimerce platform is the intellectual property of Aimerce.io. You are granted a limited, non-exclusive, non-transferable license to use the platform during your subscription period.

Content you input into Aimerce (product URLs, mockup images) remains your property. AI-generated outputs produced from your inputs are yours to use commercially.

9. Disclaimer of Warranties

Aimerce is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or that AI-generated content will meet your expectations or comply with all applicable advertising policies.

10. Limitation of Liability

To the maximum extent permitted by law, Aimerce shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: lost profits, ad spend, revenue, or data — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim shall not exceed the amount you paid to Aimerce in the 3 months preceding the claim.

11. Termination

You may cancel your account at any time from your account settings. We reserve the right to suspend or terminate your account immediately if you violate these Terms, without refund.

Upon termination, your data will be deleted within 30 days in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you via email or an in-app notice at least 14 days before material changes take effect. Continued use of Aimerce after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
